Abstract


Foreign acquisitions of real estate legal issues for the study, analysis and argument on the basis of foreign investment legal system , introduction of real estate analysis real estate foreign acquisitions and real estate foreign investment relations , focusing on real estate the foreign acquisition contract legal problem . On this basis , further analysis demonstrated relief methods and laws applicable to the contracts of foreign acquisitions of China's real estate . The structure of this paper is divided into five parts: The first part of the preface . The main contents include : the process of historical development of foreign investment in China's real estate industry ; foreign investment in China's real estate by foreign investors to develop the role and significance of China 's real estate development ; objectivity and inevitability ; practical significance to study foreign acquisitions of real estate contract law issues ; This article aims and research methods. The second part , foreign acquisitions of the legal system of China 's real estate . The main contents include : the concept and meaning of the Real Estate Foreign Investment Development and Real Estate foreign acquisitions ; foreign acquisitions of real estate legal framework and legal system ; foreign legal form of the acquisition of real estate . The third part of the legal issues of foreign acquisitions of real estate contract . The main contents include : the basic legal issues of foreign acquisitions of real estate contracts ; foreign acquisition of real estate in the terms of the contract law . The fourth part , the applicable legal remedies and legal foreign acquisitions of real estate contracts . The main contents include : remedies for breach of contract and limitation of liability rules ; Limitation of Liability for breach of contract ; foreign acquisitions of real estate contract law applies . The fifth part , conclusion. The acquisition of this article , in the way of foreign investment , while the acquisition of the operating rights , usufruct and disposition of the domestic real estate enterprises in China belongs to the development and construction of real estate projects ; controlling interest in the real estate business . The investment purpose of the acquisition and the results of the performance of the contract , is the transfer of decision-making power of the real estate business management ; owned real estate development and construction projects of the real estate business the right to operate , the transfer of the usufruct and disposition . The main objective of the acquisition is a real estate development and construction projects , and earning power . Rather than the real estate business itself . Therefore, this acquisition is defined as real estate acquisition .
