Abstract

ADR——Alternative Dispute Resolution——has developed speedy in the United States sincethe 20th century. Arbitration is the most important dispute resolution of ADR. After the ModernAmerican Arbitration System Established, it has becoming popular because of its convenience,secrecy and self-rule. In China, studies of Modern American Arbitration System are inchoate.There is no monograph in this field. The lack of scholarship on this subject is curious, so lots ofwork needs us to do.In this paper, the author attempts to tackle Modern American Arbitration System, whichincluded two perspectives: American Arbitration Association and American Arbitration Law. In order topilot study on Modern American Arbitration System, the author will mouse out the establishmentof modern American Arbitration System, then clear about the evolution of the two importantaspects of modern American Arbitration System. After that, its functions to the society andcharacteristic will be contemplated.The text is divided into three parts:First, the establishment of modern American Arbitration System. Modern AmericanArbitration System comes of archaic Europe Arbitration. Before it is established at thebeginning of the 20th century, nonage arbitration come through a long evolution.. Symbolized bysignature of the Federal Arbitration Law and the foundation of American Arbitration Association,modern American Arbitration System was established. It was the inevitable result under somehistorical cultural origin. Progress of American economy, law practice and society culture areincluded.Second, the development of American Arbitration System. This matter will be divided intotwo aspects too. Since American Arbitration Association was founded, it has come into beingcharacteristic during the process of its development. American Arbitration System acceleratesthe revolution of multifarious dispute. American arbitration law relates to Federal ArbitrationLaw and The Uniform Arbitration Law, whose constitution and perfection means thedevelopment of American Arbitration System. The rules of American Arbitration Association arecarriers of arbitration procedure.Thirdly, the functions of American Arbitration System to the society and its characteristic.the functions of American Arbitration System is multiplex. American Arbitration Systemconsolidates people’s self-rule, offers consultation on lawmaking, takes in hand the duty of thecourt, gives alternative dispute resolution and keeps society harmonious.In the concluding part, the author summarize the dispute resolution methods in our society,then generalize analyze the Chinese Arbitration System and point out the problems of it.
