Abstract

With speeding up of the advancement of the democratic politics and the transformation of governmental function, the status of paying and servicing administration gradually raises. Traditional administrative goal and the administrative method start to change. The government provides the public service as the important content of fulfilling the government function, to adapt the social environment which unceasingly changes and to solute the social question which unceasingly appears. Accompany with this, the force of the administrative method unceasingly attenuates. More and more, it manifests the democracy and consultative character, manifests the humanities spirit of service cooperation, trust and communication between the two parties. Therefore, the contract administration occupies the important status in the administrative activity day by day, which emphasizes the bilateral consultation and agreement.This article divides into four chapters, developing the question on administrative contract with the new tendency of current administrative law. First chapter elaborates the new tendency of current administrative law on party, the administrative method and the administrative idea. Second chapter introduced various countries administration contract with the new tendency of current administrative law. Third chapter are about regulations function through reason type standard terms revolving the new tendency , promotion administration democratization function. Participation from the citizen Fourth chapter elaborates constructed to our country administration contract system construction, from two aspects the contract idea and the administrative contract law systemThere are these characteristics in this article: (1) it elaborates the new tendency of current administrative law; (2) it elaborates the function of regulations and control of power. They are one bidirectional process, one hand, administrative power authorities the citizen right, on the other hand, the citizen right controls administrative power. (3) it suggests to set up contract idea in our country and constructs the law system of administrative contract on legislation, relief and procedure, in our country, legislation, the procedure relief.
