Abstract


The justifications of punishment is very important in the principle of criminal law.By the idea of humanity and value-the two idea of metaphysics,is intending to offer a comprehensive and rational theory about the justification of punishment on the basis of a detailed description and analysis as well as careful sifting of various theories a vailable in this world.The paper,by the marxrist standpiont of value and humanity,especially the viewpoint of punishment value,such as the value of means and ends,is trying to achieve a new thinking of the justifications of punishment.This means:the justifications of punishment is establishing failth to punishment,and at present ,is establishing a stystem of reasonable punishmentThe fulfil of this paper is in the hope of providing superficial suggestion of establishing the justifications of punishment.
