Abstract


The fisherman’s fishery rights and interests are the basic rights and interests that the fisherman survive and develop. With the development of market economy, the implementation of different construction plans, the development of the marine resources, and other all sorts of reason, the problem of encroach on fishery rights and interests becomes more and more important. Protecting the fisherman’s fishery rights and interests has already become a great subject that government has to face. Then, how to protect fisherman’s fishery rights and interests? This paper will divide four parts and launches to research this problem:First part: The summary of the fisherman’s fishery rights and interests. The fisherman’s fishery rights and interests, mainly contain cultivated rights and fishing rights. At present, the fisherman’s cultivating right and fishing right has received much hurts and threats. It think it has many different reasons, so this paper will make some essential explanation of protecting fishery rights based on analyzing these phenomenon of hurt and threat.Second part: The research on fishermen’s fishing rights. At present, the main cause of the threat of fisherman fishing rights is that, the fishing place is tied up unreasonable, the fishery environment and resources is getting worsen, and the fishing access system is not complete. For this reason, the countermeasure of this paper suggests paying attention to protect the fishery environment and resources, maintaining the order of fishing place actively, improving the fishing access system, and then I will put forward the suggestion on the basis of above.The third part: The research on the protection of fishermen’s cultivated right. At present, the origin cause of threatening fishermen’s cultivated rights is that, the fishery cultivated water areas can not be planed completely, the requisition of fishery water areas and slough is incompletely reasonable, the cultivated access isn’t normative and so on. For this reason, this paper puts forward the corresponding countermeasure on above.The fourth part: The almsgiving of fishermen’s fishery rights. The right needs almsgiving, or else it will be an insecure right. In my opinion, the fisherman’s fishery rights and interests should be protected, should not merely protect the cultivate rights and fishing rights, but also enhance the degree of fishermen organization, establish the
