Abstract

We established the entirely different and“two dollar system”of the social guarantee system. The old ages insurance is the important content of the social security. It also presents the typical model of“two dollar system”under the influence of the system. These marked the law system of“old ages”social security to be a kind of not balance system essentially. One hand, the most of farmers are rejected the“old ages”social insurance, on the other hand, the residents are enjoying the more perfect the“old ages”social insurance. In the very long period, this kind of phenomenon is thought reasonable. With the development of our country market economy and the reformation of the economic system, we have the necessity to re-examine this system. As early as 1942, one famous writer put forward the important principle about setting up the system of social guarantee. The principle is“overall widespread”and“differential treatment”. Namely, That the social guarantee not only overlaid the object as the citizen, but also drawing up the different standard of the social security according to the different social members. However, in building up the system of our country social security, we seemed to even emphasize on the different treatment between the city and the countryside.Currently, the“old ages”social security of countryside is not perfect, which seriously baffles the development of countryside’s economy and the excitation of the farmer’s income, affects the social safety and the social justice. Simply depending on the land and family hardly can solve the challenge of the advanced age and the crisis of the farmer’s retiring to enjoy life. Developing and perfecting the“old ages”social insurance of the countryside is put on the calendar. This essay is divided into 5 parts, consisting of 40,000 words.Part1: The basic issue about the law system of the“old ages”social insurance of the countryside. The author introduces the relative theories about the“old ages”social insurance and the“old ages”social insurance of the countryside. The definition of the law system of the“old ages”social insurance of the countryside and the comparison of the related law system.Prat2: Firstly, analysis the necessities and the realization of perfecting the countryside social insurance from nation aspect. Raise the reasons and the meaning of building the law system of countryside social insurance. Analysis the economic capabilities of building the law system.Secondly: Analysis the necessities and the realization of perfecting the countryside social insurance from the farmer’s aspect .Raise the reasons and the meaning of buying countryside social insurance. Analysis the economic capabilities of buying the insurance for their future.Lastly, from practice, some areas already have changed a lot from building countryside social insurance.Part 3: Capering the foreign nations’countryside social insurance law system in legislation model, social and economic environment and specific articles, we get the conclusion of our disadvantages of our countryside social insurance, and how to reform it.Part 4: Study the current countryside social insurance law article, raise the main issue of our rules.Part5: Establish the constructor of our future countryside social insurance.
