Abstract


Crimes of corruption of public officials in the hands of public power for personal gain for the individual acts of corruption. Therefore, the correct understanding of the crime of corruption objects related to how to correctly identified the nature of the crime of corruption. Meanwhile undoubtedly also correctly identified whether it constituted a crime of corruption one of the prerequisites. So, for crimes of corruption committed against the study appears to be particularly important.Based on the review of our traditional corruption of the crime targets, The new Penal Code of the crime of corruption was committed against a relatively detailed exposition and to improve the penal legislation and judicial practice was to explore the practicality. Following is the full text is divided into three parts :The first part , "public property" determination. Given our traditional view that corruption is targeted at public property. Due to the existing penal provisions of several of the crimes of corruption, therefore, "corruption is directed at public property," the traditional view of the question.The Second part , "of the property units" identified. Due to the economic reform needs to happen in non-state-owned companies and enterprises, public institutions, Social groups of countries who use their positions to facilitate illegal possession "of the unit property", not whether its "public property" are defined, as long as the crimes of corruption with the main requirements can be convicted.The third part , several "special properties" identified. Its conformed to the market economy reform, adhere to the "strict sanctions national staff crime" legislative intent.
