Abstract


Divorce Damage Compensation System is the increase in China 's Marriage Law Amendment as a right to relief system designed to protect the legitimate rights and interests of the innocent party in the marriage relationship , the fault led to a divorce party liable for damages to the innocent party responsibility. The requirements of the system to fill a gap in China 's Marriage Law , the law on the protection of the legitimate rights and interests of the parties to the marriage further judicial referee with the basis of the law , is a big step forward in our marriage and family legislation related cases . But as a new legal system , it is still significant rough , highlighting the defects and shortcomings in the legal process of application is yet to be perfected . This paper systematically analyzed the system , pointed out that the legislation of the parties as well as the amount of compensation and other aspects of its provisions filed of divorce damages legal reasons , divorce damages defects , proposed broaden filed for divorce the scope of damages for legal reasons , clearly defined \benefit.
