Abstract


International finance leases with respect to traditional leasing is a new trading facility for international capital and developing countries, the use of foreign capital has a positive effect. However, due to the characteristics of a financial nature of international finance lease transactions, coupled with the international financial leasing foreign, making it more prone to a variety of risks with respect to traditional leasing and domestic finance leases, which will undoubtedly finance lease transactions security impact, and thus hinder the development of the international financial leasing industry. Therefore, the law on international financial leasing risk prevention and regulatory legal system is of great theoretical and practical significance. In this paper, a comparative analysis and empirical analysis, a more systematic study on International Financial Leasing legal risk prevention and regulatory legal system. The first chapter describes the meaning of the International Financial Leasing and its main types of risk, which focuses on the definition of \the underlying causes of international finance leases risk - Credit ownership detailed analysis and discussion, and the International Financial Leasing risk control in two ways - the parties to use legal means to use legal means to prevent as well as international supervision; three chapters introduce international finance lease transactions in several typical risks, including the risk of ownership of the leased property, the lease the right to recovery risks and lease the risk of bankruptcy, and each of these three is more common and prone to the risk of legal precautions careful analysis and research; Chapter International Financial Leasing regulated domestic legal system and the international legal system, and then the pros and cons of the regulatory system analysis and reflection to our guidance; fifth chapter of our finance lease regulatory status quo system and the problems are introduced and analyzed, and the suggestions for improvement. In short, to promote the healthy development of the international financial leasing industry and prosperity, we must guard against the risk of a variety of international finance lease transactions, this requires the parties engaged in international finance lease transactions on a variety of risks and risks arising from factors have sufficient knowledge, and then take all possible legal means to prevent, on the other hand, legal and regulatory requirements of State and Government on the financial leasing industry, in order to better safeguard the security of transactions. For our country, the regulatory legal system is imperfect hindering the development of China's financial leasing industry is an important factor, so learn from the successful experience of other countries to solve the defects and problems of finance leases regulatory legal system is one of our research important content.
