Abstract


Implementation of the Montreal Protocol on Substances that Deplete the Ozone Layer (hereinafter referred to as \The commonality of effective national control of ozone-depleting substances legislation, improve and control of ozone depleting substances legislation to make a few suggestions. The first chapter describes the basic knowledge of the ozone layer, why the international community to protect the ozone layer and the Protocol system, analyze the implementation of the Protocol and domestic control of ozone-depleting legislative relations. Any countries have ratified the \is the most important issue to be solved by the domestic legislation. Protocol legislation setting a clear goal for world control of ozone-depleting substances; countries scheduled performance is a necessary precondition for effective operation of the system Protocol, domestic legislation provides a solid legal foundation for the countries scheduled performance. The second chapter describes and analysis of three representative countries of the Asia-Pacific region control of ozone-depleting substances in the current legislation, trying to sum up the effective control of ozone-depleting substances legislation common. India and China are the producer of ozone-depleting substances, and a reference in the control of the production of ozone-depleting substances; Thailand attaches great importance to cooperation between government departments and enterprises, promote Substances that Deplete the Ozone Layer, the abatement plan carried out on the basis of the enterprise support and achieved certain results, certainly for the United Nations Environment Programme; Philippines in 2004, the latest revision of ozone-depleting substances Chemicals Control Act, HCFCs and HBFCs included in the scope of control of the Act, is one of the developing countries into the lead on behalf of legislation to control HCFCs and HBFCs. Article third, four chapters analyzed the legislation guiding ideology and principles for the control of ozone-depleting substances and the legal system, the legislative principles include the the targeted principle of harmonization principle, the principle of fairness and feasibility of the principle and comprehensive strategic principles. The main legal system, including a permit system, the quota system, recirculation systems and economic stimulus system. Chapter V of the article above analysis of the basis of the current legislation, to improve our control of ozone-depleting substances legislation put forward several legislative proposals and design specialized single-line legislative framework.
