Abstract


Bribery crime by means of influence is added in Amendment Seven of Criminal Law, which brings about the new task and requirement for the anti- corruption. At the same time, the criminal law of china has been expanded and improved further. But , close relatives, closely-related person and other concepts have puzzled in criminal judicature. The thesis, based on the existing criminal law theory, mainly describes legislative evolution, legislative background and analyzes the constituent elements of the crime. The thesis also analyzes the difference and connections between related crimes. Finally , the author, on the deep theoretical level, elaborated about how to identify the difficult problems in judicial practice, and proposed perspectives : the range of close relatives should be in accordance with stipulations of criminal procedural law; relative departments should define the concept of closely-related person; influence should be limited to non-power influence .
