Abstract


The rapid development of electronic commerce brings about lots of E-commerce disputes, which provides opportunity for the germination and development of online arbitration. As a new style of dispute solutions, online arbitration possesses the advantages that traditional arbitration and litigation don’t have. However, some obstacles must be overcome before it is widely accepted. From the view of macroscopic,high efficiency, virtuality and other features of online arbitration pose challenges for the realization of due process. From the view of microcosmic, whether all steps of online arbitration, online arbitration institutions and the staffs are fair will also influence the realization of due process to some degree. This paper suggests that through certain technical methods and reasonable control of the procedure of online arbitration can largely realize the due process of online arbitration as well as the independence and fairness of online arbitration institutions and their employees. Meanwhile, as China’s online arbitration features starting late and lacking due process, this paper puts forward specific perfection measures, with a hope to promote the sound development of online arbitration system in China.
