Abstract

Currently, the United States, England, Japan and many other countries have already given compulsory characteristics of the third-party liability insurance on motor vehicle with the form of the law ruling, and built up the system of the third party liability compulsory insurance on motor vehicle respectively. The development of the third party liability insurance of those countries proves that such system could not only effectively scatter indemnity risks of anyone who cause traffic accident, but also make assurance of covering the victims’losses.In our country, with the rapid development of economics, the number of motor vehicle increases very fast which result in the traffic accident rate raises year after year, the issue of how to compensate the traffic accident victims’losses becomes a serious social problem. For the purpose of relieving the social conflicts and assuring the victims’ interests our country has profited from the developed countries’experience”“Ordinance of Insurance of the Vehicles Damage to the Third Party”has been passed in July 1st 2006. This is the sign of implementing of The Insurance of the Vehicles Damage to the Third Party System. In more than two years of practice, this system got a rapid promotion. But there are still insufficient in both legal level and system level. The key of improving this liability insurance system is to solve the distribution problem of all the participator. In this article, the author has held a new idea of“cooperation system of The Insurance of the Vehicles Damage to the Third Party”. Divided with legal rules, the cooperation system emphasizes the coordination of the system measures. Of course, enough analyze has been given to the topic of integrating of legal rules and cooperation system. The experience of some developed country or districts is significant to our country.The main structure of the article contains four parts. Part 1 is the introduction part of the article. It mainly discusses the research background, the significance of the research, the contents and methods of the study. In part 2, a general speaking of both“The Insurance of the Vehicles Damage to the Third Party”and its cooperation system is stated. Comparing the Cooperation System of The Insurance of the Vehicles Damage to the Third Party in several countries and Taiwan is the main content in part 3. This comparing is followed with the analyzing of our own country. In the fourth part, two topics are discussed. The first topic is the direction of the improvement of the cooperation system. While the second focuses on how to establish a entire system to give victims better protection, who suffered from the traffic accidents.The main contribution lies in the following aspects. First is on the topic selection. This paper emphasize on how to improve the system of the insurance of the vehicles damage to the third party in our country. Second, on the idea of the study, this paper focuses on the macro view and micro view combined and foreign experience and domestic condition combined method.In conclusion, the writer hopes that this paper could make a little contribution to the establishment of the system and the relative research work.
