Abstract


This essay focuses on the jurisdiction of the bankruptcy cases, and analyses the district and grade jurisdiction of the bankruptcy case. Also the essay talks about whether the objection could be proposed over bankruptcy cases.In the first part, the essay introduces the jurisduction of bankruptcy cases briefly, and the importance of the jurisduction of bankruptcy cases. Then the author lists the jurisdiction rules of bankruptcy cases in different countries . The essay compares the differences between the bankruptcy cases and the ordinary civil cases by.In the second part, the essay introduces the district jurisdiction of bankruptcy cases in different countries and also in China. Then analyses the shortage of the district jurisdiction of bankruptcy cases in our country and gives suggestions for the district jurisdiction of bankruptcy cases in China.In the third part, the essay introduces the grade jurisdiction of bankruptcy case. Firstly the essay lists and analyses the shortage of the grade jurisdiction system in China. Secondly the essay shows the theorical views about the grade jurisdiction system and analyses the shortage of such theorical views. Thirdly the essay gives suggestion for improving the grade jurisdiction of bankruptcy cases by learning from other countries.In the last part, the essay focuses on the objceton over the jurisdiction of bankruptcy case. By analyses the shortcomings of the theorical views about whether the objection could be proposed over bankruptcy case, the essay shows the procedure of trial over such objcetion and on this basis gives the suggestion about the struction of the legal procedure about the objection proposed over bankruptcy cases.
