Abstract


The chaos of civil Enforcement and the difficulty in execution has been remitted since the reform on civil procedure act in 2007 year.But the situation is still severe.because the legislation is not perfect, the executive person’s quality is also not high ,what’s more the supervision mechanism is not imperfect and so on.the People began to realize that establishing a set of effective civil enforcement mechanism is a good choice , especially in recent years,the people has been actively explore into the necessary to construct the civil enforcement Procutatorial Surveillance mechanism and how to construct the mechanism.However it still is a matter which people have diffent opinions.it is also the the focus of debate in 2011 annual meeting of the civil lawsuit. Given the civil procedure law have been included in the modification of the National People’s Congress the opportunities of the legislation program, the National People’s Congress legal work committee also tried to establish the civil enforcement procuratorial supervision system. therefore, the paper probes into the related problems about the civil enforcement procuratorial supervision system has the profound realistic significance to China’s current judicial reform.This article is divided into six sections :The first part is the related basis theory. and the background. The second part Mainly analyze the necessary to establish the civil enforcement procuratorial supervision system.The third part mainly talk about legitimacy to establish the civil enforcement procuratorial supervision system.The fourth part is the difficulty to establish the civil enforcement procuratorial supervision system. The fifth part is the construction about the civil enforcement procuratorial supervision system.The sixth part is take full use of the opportunity of Comprehensive amendments to the civil procedure law,put forward my legislative Suggestions. separately from the legislative origins, the legislation idea and legislation system.
