Abstract


Death as a punishment, has always played an important role. Claims that retain the death penalty people think that the death penalty conforms to the social contract theory, accord with public opinion, for malignant crime has huge deterrent effect. Advocate the death penalty abolition of people think of death penalty against social contract theory, is the brutal punishment, do not accord with humanitarian, once the wrong kill cannot error correction. In 1997, the criminal law of 68 species of death and 2011 the amendments to the criminal law is cancelled 13 item of economic crime death penalty. The death penalty should be said that the preservation or in certain period in history will debate. This paper attempts to our country’s economy, politics, history, culture, and perspectives of abolishing death penalty, expounds the origin of the death penalty, debate, puts forward the measures of the death penalty. In order to further perfect our country’s death penalty system make some exploratory research and analysis.
