Abstract


The allocation of the initiator of forensic psychiatry expertise has great effects on if psychopaths should bear their criminal responsibilities, or how much should they bear. It also affects the realization of victims and their family’s profit, affects people’s trust towards public security, even affects if public wrath can be cooled down.The initiator of forensic psychiatry expertise system of China has long been citied by scholars. At the same time, scholars designed other systems trying to solve this problem.Based on contextualize, this thesis unscrambled and analyzed those scholars’questions and methods, tried to prove the initiator of forensic psychiatry expertise system of China completely corresponds to the structure of political authority, the mode and value of criminal justice, the legal culture of lawsuit and the mental healthcare system, and it is historically equitable. In case of the same background, any assumption of change is unrealistic.Of course,historically equitable doesn’t mean invariant. As the environment changes, we should also improve our system and lead it to the final perfection. This thesis designed future system regards to Chinese circumstances; hope it can provide theory supports to the initiator of forensic psychiatry expertise system reform.
