Abstract


This paper mainly is consisted of the following content:First, the preamble. This part mainly introduces the pratityasamutpada，significance and the research status of this topic. Also，it makes Goal and ScopeDefinition of law，which is the core concept of the whole paper.Second, the background of the ideology of laying stress on law in late HanDynasty，and it is the guide of this paper. It analyzed the imputes from political,economic, and social factors. Such as politically, the known relative family throughmarriage with royals and the Eunch manipulated politics alternately, which cause thegovernment to the jeopardy of collapse. Diplomatically, Qiang ethnic minoritybegan to fight with Han Dynasty, which became a serious crisis. Economically, theunhealthy ways and customs of luxury and the rising of powerful landlords affectedthe stability of the society, and make most yeomen to the situation of extreme poverty.Third, the basic content of the ideology of laying stress on law in late HanDynasty. This is the core part of this topic, mainly discusses the Scholar Officials’countermeasures to the crisis from legal aspects. They inherit the traditionalConfucian humanization thought mainly, at the same time, they also began to resort tolaw to solve the political problems. Some of them even looks like a believer ofLegalist School, and Wang-fu, Zhong-changtong, Xun-yue were the representative .Fourth, connected with the former point, the Scholar Officials payed attentions tothe quality of the monarchy and the bureaucratic teams. In feudal society, theappliance of law can not be divorced from the participation of personnel. So theScholar Officials demand the monarchy conform to the law, and respect these who areof noble morality.Fifth, the affect of the ideology of laying stress on law in late Han Dynasty. Atthat time, because of the volatile political situation, most of their assertions wereignored. But in the following dynasty, such as Cao-wei and Shu-han, some politicians, Cao-cao, Zhuge-liang, applied it to the government management. And it still makesense to current legal construction.
