Abstract


In order to gradually establish and complete the legal system in VN. standards consistent with the international law. and create better conditions for international integration to VN. In2004. VN enacted "ordinances against dumping imports". But this ordinance is just a repetition imperfect provisions of anti-dumping agreement of the WTO (referred to as ADA), so the ordinance is relatively simple ordinance. Since the effect, due to many reasons that an ordinance has not been applied in practice.Thesis consists of4parts. Chapter1introduces key concepts and analysis of Dumping, Anti-Dumping. the development of anti-dumping law and its impact on the development of marketing field. Anti-dumping laws is a tool to protect domestic goods, but in special cases, it also brings great harm to the economic benefits. Chapter2analyzes the major concepts in anti-dumping ordinances of VN as:regular price, the export price. the domestic manufacturing sector, material injury, threat of material injury etc..... Chapter3primarily in the investigation process analysis. process-dumping cases, application of anti-dumping measures and analysis of enforcement mechanisms of anti-dumping ordinance.2.3When analyzing the first chapter the author will point out the limitations of the ordinance, and compare with the WTO rules and laws of the United States. Canada. EU. Chapter4analyzes the major shortcomings of the ordinance from which to devise corrective measures and gradually completed ordinances.
