Abstract


Population aging has become the general trends and major challenges for the development of human society in the21st century.China in the21st century will be an irreversible aging society.The impact of population aging, involving almost every aspect of society, the Government must take positive measures to deal with.Respond to the challenges posed by an aging population requires the support of the legal policy, requires to establish a law-based policy supplemented by legal and policy system.Part Ⅰ, The challenges of the aging population.The effects of population aging includes social security, economic construction, family structure and social ethics.Part Ⅱ, Build legal protection system of China’s aging population. After three stages of the exploration, development and improvement,the construction of the legal and policy system of Chinese population aging had becomed perfect, but also has some disadvantages, including the low level of protection, operability is not strong, the relevant mechanism is not perfect.Part Ⅲ, By analyzing abroad to cope with the aging of the population of foreign experiences and practices, the security system of China’s legal policy should reflect fairness, the Freemasons, universal and sustainable development.PartⅣ,China’s legal and policy system build should cover the protection of basic rights and interests of the aging service system, social management and the elderly development, and the basic principles of China’s construction work is combining rigid requirements and flexibility standards, equal treatment and the differences in support, basic needs and improve the quality of development, mandatory security and actively guide, Co-ordinate collaboration and shared responsibility, the legal and policy. The main content of China’s construction work includes protection of basic rights, aging Services System, Social management and Elderly development. PartⅤ, In accordance with the framework of the current system of regulations and policies on aging in China, the authors proposed that, China’s regulations and policies on aging system should be based on the basic legal, special laws and local regulations for the trunk, supplemented by policy guidance, carry out the construction of the protection system of legal system、policy system and interests of the maintenance system.
