Abstract


The victory of October revolution opens a new era of mankind’s history.How tosecure the Soviet regime, how to construct socialist legal system, revolutionaryteacher Lenin stressed on it.He insisted on the guidance of marxism, based on theactual conditions of Russia, began to explore for proper socialist procuratorial system ofthe Soviet Union，and formed rich Russian characteristic socialism procuratorial thoughts.These thoughts not only laid the cornerstone of the Union of Soviet Socialist theory ofprosecution system, but also had a major impact on the construction of China’sprocuratorial system even to the whole judicial system.The paper reveals the historical background and theoretical origins of Leninprocuratorial thoughts’formation, systematically combing and overviewing of themain content of procuratorial thoughts including: the independent exercise ofprosecutorial power, emphasizing the judicial attributes and the independence of theprosecutorial power; froming a top-downvertical leadership system, to maintain theprocuratorial organ’s authority; emphasizing the Russian has unified legal system,tosupervise all countries organs’behavior;Procuratorial power not only has the generalsupervision function and lawsuit supervision function, including supervision of theordinary criminal cases, civil and administrative actions; The paper discusses thelinks and differences between the Soviet procuratorial organs and investigativeagencies.Refining characteristics of Lenin Procuratorial thoughts,namely people,practice and innovation.Procuratorial thoughts must be rooted in the procuratorial practice, so that canbetter bear legal procuratorial organs’great responsibility and sacred mission. Leninprocuratorial thoughts is the theoretical guide for China’s procuratorial supervisionpractice, it provides important theory basis for our country’s procuratorialdepartments to safeguard the socialist legal system’s unification, exercise its authorityindependently, fully fulfill their lawsuit supervision function and curb lawenforcement personnel corruption, safeguard the legal rights of prisoners.Studing andresearching on Lenin’s procuratorial thoughts, is of important theoretical andpractical value on guiding Chinese characteristic socialism procuratorial practice
