Abstract


As members of society, women play multiple roles in social activities. With the developing of society, women play more important roles than before and their social positions have been greatly enhanced accordingly. Meanwhile, there have been special provisions regarding women in criminal codes in all countries because of their special physical, psychological and social characteristics of sex. In China, women have been provided specially in the current penal code. There are not only special charges to protect women but also heavy penalties on the violation of women’s legal rights. Also the female offenders have privilege rights in the sentencing and execution. However, women’s victimization rates and crime rates have not decreased accordingly. with the development of new situations and problems, the limitations and defects of current criminal laws are more and more obvious and striking, especially in following points:special rules do not fully reflect women’s special characteristics, the special protection rules are not enough, only a few women match the special protection range, the special protection system is too limited to protect women well. The above problems make the law perform badly and make the principle of humanitarianism of our country’s penal code fall behind international legislation tendency. Therefore, the following special measures should be taken in order to improve our current crime legislation:making more special rules for the women of the execution system, expanding the special protection range of the crime handled only upon complaint and adding special protection rules in violent crime.
