Abstract


This paper firstly made a system of the religious and legal construction ofsocialism with Chinese characteristics in the new period to carry out the theoreticalbasis and necessity; Secondly, in the management of religious affairs of socialismwith Chinese characteristics according to the main line to do the development of thereligious and legal construction in China the stages to comb; Three is summarizedsince the third plenary session of the eleventh, the achievements of the religious andlegal construction of socialism with Chinese characteristics; Four is summed up tosort out the religious and legal construction in China are highlighted in the new periodof Chinese characteristics; Again, combined with the problems in the religious andlegal construction in our country, with the basic theory of marxism and the theory ofparty policy, from China’s actual conditions, try to make for the perfection of thereligious and legal construction in China.The text consists of five parts.The first part, demonstrate the basis, necessity of the religious and legalconstruction. From the basis, marxist theory of religion is the basis of the religiousand legal construction, legal system construction of our party’s theory of religion isreligious direct theoretical basis. From the analysis on necessity, strengthening thereligious and legal construction in our country is the inevitable requirement ofreligious work; Is to implement the strategy of governing the country according to law,build the rule of law society needs; Is advocating people-oriented, building aharmonious society needs.The second part, review and summarize the development course andcharacteristics of the religious and legal construction of the People’s Republic ofChina. The religious and legal construction of the People’s Republic of China hasexperienced the exploration of the new democratic revolution period, after thefounding of the reform and opening up before the basic establishment and the tortuousdevelopment period, and since the reform and opening fully established and thecomprehensive development of the historical period. Religion in the process ofcontinuously explore, China legal system gradually perfect, realized by dependentirely on the religious policy to the management of religious affairs by religiouspolicy supplemented, religious regulations management of religious affairs, to givepriority to with religious law, guided by the religious policy of historical transformation.The third part, the overview and analysis of the religious and legal constructionof socialism with Chinese characteristics in the new period. With Chinesecharacteristics the basic establishment of religious legislation system framework,religious law enforcement and steadily push forward socialism with Chinesecharacteristics, with Chinese characteristics of the religious dissemination activitiescarried out effectively. Sure result, find out shortage, make up the shortfall.The fourth part, comb and analysis system with Chinese characteristics of thereligious and legal construction in the new period. To ensure freedom of religiousbelief, religious harmony and social harmony for the purpose, adhere to the freedomof religious belief, the separation of church and state, an independent unity BanJiaoand rights and obligations such as basic principles with Chinese characteristics;Summarized in constructing the religious and legal construction with Chinesecharacteristics in the process of valuable experience.The fifth part, summarizes the religious and legal construction with Chinesecharacteristics in the new period in the process of the problems and perfect thethinking. According to the religious and legal construction process with Chinesecharacteristics in the new period in the legislation, law enforcement and thefranco-prussian appeared and the existing problems, combined with China’s actualsituation to explore improvement methods.
