Abstract


Contract violations are a natural person, legal person or other organization to reap ill-gotten gains to achieve its purpose, in violation of laws and administrative regulations of mandatory requirements, the use of contract implementation damage to national interests, legal rights and collective interests or the interests of the behavior of others. Violations of the legal regulation of contracts, parties to the contract is to protect the legitimate rights and interests of the socialist market economic order, a necessary requirement to establish a complete system, well-functioning system of legal regulation of contract violations, China’s current legal system is an important task.In addition to Introduction and Conclusion, the paper is divided into four parts:The first part defines the meaning of the contract violation and the specific performance of contract violations. A clear violation of the contract violation is imposed, harm national interests and social public interests, and clearly illegal contracts and contract violations tie and differences. Specifically, the contract violation, including contract fraud, the use of contract damaging national interests and social public interests, behavior and abuse of standard terms to help illegal.The second part describes the law of contract violations need for regulation. Legal regulation of contract violations is the inevitable limitations of freedom of contract requirements; violation of contract law regulation is an important aspect of modern government functions; violation of the contract to be legal regulation is to make up for the limitations of judicial remedies necessary means.The third part introduced the contract null and void system, standard terms supervision, administrative mediation and other means of legal regulation of contract violations, and analysis of its own shortcomings.Part IV put forward a sound system of legal regulation illegal contract proposals and strategies
