Abstract


Over the last decade , the rapid development of network technology and the rapid popularization of copyright increasingly get an extension and expansion of the network environment , the rapid growth of network environment under copyright disputes , intellectual property disputes , the main type . Judicial protection of copyright under the network environment often suffers due to the special nature of the network environment , many issues worthy of further study and the urgent need for the legislature or the judiciary through the form of a legislative or judicial interpretation to be clarified , such as how to determine the proper defendant , web content and technology services provider for what responsibility principle, and how to determine the subjective fault of the network service providers and to determine its tort liability . The principle of attribution for the effective protection of copyright under the network environment , the larger main problem for the the controversial civil judicial protection of copyright of our network environment , such as web content service providers and network technology service providers , network technology subjective fault identification of service providers , network service providers the indirect nature of tort liability discussed , published their insights and be sound advice .
