Abstract


For a long period of time, the theoretical study of the criminal and judicial practice showed a clear trend, mostly from the standpoint of the protecting the rights of a suspect (defendant), the protection of the rights of the victims has always been covered by the prosecution, punishment and protection of the rights of criminal suspects (accused). Every country in our world is concerned with the issue of rights Protection, which is also an important symbol of Perfecting national legal system and democratization. In area of criminal procedure, the rights of suspects and defendants have been detailed, but the regulations on the rights protection of victims are few.Since the end of the Second World War, the voice requesting criminal procedure to protect victims rights run increasing high. The victims in criminal proceedings in the many countries are getting more and more attention. The revised the Code of Criminal Procedure of our country has defined the criminal victims as the litigants and were provided many new rights, however, in practice victims in criminal procedure did not have the full rights of litigants, the protection of victims’ legal rights and interests came with many questions. The paper consists of four major parts except the introduction and conclusion.The first part, it’s an overview of the rights of the victims. First of all, from different disciplines of the law "victim" was defined in different ways. Secondly, this article mainly elaborates the legal basis of protection of the rights of the victims from the protection of human rights and the balance of interests of litigation. Finally, this article mainly focus on the value of protection of the rights of criminal victims. The second part, this article mainly elaborates the change and development of protection of the rights of criminal victims.The third part, this article mainly elaborates the present situation of protection of the rights of victims, and genetic analysis of the problem.The fourth part, this article mainly elaborates how to improve the system of protection of the rights of victims in our country. To reiterate in the conclusion: strengthening the protection of the criminal victims does not mean denying or restricting the rights of the accused has had, but trying to change focusing only on protecting the rights of the accused in the past. And the most importantly, we should try our best to put the imbalance of the state of criminal justice back in position.
