Abstract


The judge has the power to survey evidence . Adversary litigation mode , the judge in order to maintain a neutral stance , easily will not take the initiative to investigate the evidence . The Power of the litigation system gives judges actively investigating powers busy investigating judge can see even figure in the investigation stage . The judge investigating the presence of the weight of evidence is not only to help the judge to find out the truth , to make a fair referee , the prosecution and the defense in the balance of power in the course of the investigation of evidence and can effectively balance and conservation of judicial resources , and reduce the cost of justice . With the development of the modern criminal justice system , the right to judge investigating evidence gradually weakening has become an indisputable fact , to find a balance between neutrality and impartiality , the judge , this is the crux of the matter lies , perfecting our program system development context survey evidence right key to the judge in the criminal procedure system .
