Abstract


IPR border protection system has its own independent legal forms and systems, is an important symbol of the knowledge level of economic development of a country or region. China's accession to the WTO has been more than seven years, the social and economic life of our country is more and more integrated into the world economic environment, border protection system of intellectual property rights has also been considerable development and progress. However there is still a considerable part of practitioners in China's IPR border protection operation only know their documented lack the necessary understanding of the entire system of law enforcement, there are a considerable part do not know how through normal legal means to defend the rights of the relevant intellectual property rights holders, in terms of the relevant legislation, there is not unified and there are quite a lot of controversy with the international rules on IPR border protection regime the systematic basic theory to organize and conduct research on controversial issues with a strong practical significance. It is based on the understanding of this article start with the basic theory and the status quo in China IPR border protection system, this system more comprehensive generality finishing, to the reader of such a system has a more complete impression, but also for analysis of Chapter IV of this article a few specific issues the foundation; Chapter five questions for a lot of controversy in China's IPR border protection system and put forward suggestions for improvement, in order to get feedback, and promote the system sound purposes. The first chapter summary described the historical development and evolution of the IPR border protection system, and its specific concept, introduced its domestic law, international law manifestations.
