Abstract


Under financial integration’s impetus lots of financial holding company comes forth all over the world, for this, it also brings new financial rise! At present, there are all kinds of financial holding company existing in our country; because of the lagging of the legislation, many company are out of control in laws,and meanwhile,every supervision institution does things in his own way;it makes supervision of financial holding company in an empty place. However, financial holding company in China is very different, and their levels of risk management are very low, the complex stock ownership structure causes a lot of risk potential. So, we should borrow ideas from overseas successful experience, and do researches about the supervision system of financial holding company to improve the legislation , regulate the company’operation, improve Financial efficiency and protect financial security.This paper bases on Empirical and comparative analysis, and uses historical and logical methods to analysis several countries’financial holding company’supervision system, and at last summarized the insufficient of development and supervision of Chinese company, and point out the advice how to build financial holding company’law of supervision.This article to the holding company and its legal supervision on the one in charge, the paper and standardize the analysis, from the two methods of contact angle, through practical problems of specific research and in answer to the holding company theory, the monitoring of all aspects of "what basis, how should" put forward the proposal. the countermeasures. The use of economic analysis technique to the holding company of the financial supervision and law system build in the maintenance of financial security and the financial efficiency between the best cutting points. While this article in research, analysis and summary of the historical logic, to the holding company of the development of quality management system, risk management theories and empirical evidence to be compiled ,the developed countries , regions financial holdings company’s legal analysis and regulatory practices.Tried to open up the experience and financial holdings in our country be more successful development. This article also adopted the law, comparative analysis of our traditional financial supervision and law system in the depth of the review and reflective, and for different conditions and country’s holding company and its regulatory legislation to domestication of violence.Main compare the united states、britain、japan and taiwan region for the holding company and the relevant norms and practices of the financial monitoring legislation and practices may exist in the study of ecology and its institutional changes, hoping to have financial holdings company’s legal supervision of a message to a successful implementation of the advanced countries the experience ofThis paper is divided into 6 parts. Part 1 is the introduction; part 2 is mainly about the introduction of financial holding company; part 3 introduces the modes of financial holding company and financial supervision; part 4 through introduces the American、Japanese、British and Taiwan’s supervision system of financial holding company to borrow ideas to Chinese company; part 5 brings up 5 side that every sufficient to point how to build our supervision law system..The author of this paper through a new frame and two sides to hold details of supervision, concern the financial holding company’s supervision particularity. Sufficiently think over our country’s financial holding company’s particularity, concern the effectiveness of supervision. The author borrows ideas from oversea experience to make our supervision designing realizable.
