Abstract


The world today is in a knowledge-based economy and globalization era. Science and technology are primary productive force. The advanced technology is the survival and development of strategic resources, a country’s comprehensive national strength and competitiveness. Technology innovation is the embodiment of the country’s economic development is the source of power. Our human development and innovation of history shows that any country are not likely to become the leader in all techniques. Developed countries, american and japanese, german, south korea, for example, the countries of the developing history tells us:Technological backwardness of state power through access to advanced technology and its continued to be digested and absorbed, innovation and training of technical capacity. This thesis tries to probe into such parts of this issue.Firstly from the international technology transfer of the basic problem, combines existing research and technology transfer to the basic structure of the system. The main need of the international technology transfer of the basic concepts and development of the survey, and the international technology transfer the relevant international legislation and the current level of our country on the international technology transfer of the legal system, the subcommission inthe modern world about international technology transfer of legal framework.TRIPS to the international technology transfer system is designed primarily consists in the background, were the main contents and quality. This article on TRIPS legislative purpose and spirit of the subcommission on the basis of the system to resolve TRIPS Agreement, framework of intellectual property rights abuses under the rule.TRIPS Agreement essentially the united states and other developed countries and will. The basic purpose is to prevent developing countries had industrialized nations, in imitation of the global implementation of the protection of intellectual property rights standards, all the countries to reduce domestic intellectual property rights protection level of autonomy. TRIPS Agreement concerning the scope and content of intellectual property rights and protection of the provisions of the time limit is the purpose, some terms and even direct from the law. in this context, technology export control system under TRIPS Agreement with no substance and control measures depends on any changes only one aim is to the interests of the united states needs. Although china has promulgated a series of law regulations to promote and standardized technology import international trade activities. But as china’s socialist market economy system is gradually improving, the original laws and regulations are no longer able to adapt to global trends and economic development of the situation, in certain extent our technology import of foreign trade activities forming a certain limit. There are some problems in our technology import, how to improve our technological introduce legislation is the ultimate aim of this article.
