Abstract


The informatization construction was started up officially by Chinese government in 1993, while the construction in judicial practice was planned in 1996. Ten years of the informatization construction in the judicial field has got great achievement, especially in the field of litigation. Informatization has become a part of litigation procedure. It is mainly used in network registration, remote trial and multimedia cross-examination. Although the informatization in the field of litigation in China is in debug phase compared with western developed countries, it has far-reaching influence in many fields of litigation due to the high efficiency, convenience and intelligence. Embodied in lawsuit value, litigation culture, litigation ceremony and procedure. This paper mainly focuses on the positive motive function on these four aspects and tries to solve the problems in the informatization. Based on the legal principle and procedural law, this paper systematically studies the influence of informatization in the realm of litigation involving information science, economics and statistics and other relevant theories.This thesis is divided into three parts.The first chapter introduces the concept and content of informatization in the field of litigation and the application of informatization at home and abroad.The second chapter is the main part. It analyzes informatization’s influence on litigation value, litigation culture, litigation ceremony and litigation procedure. The influence is mainly reflected in the promotion of procedural justice, the enhancing of the efficiency of lawsuit and change of litigation ceremony. At last the influences on the registration pattern, duration, trial period and witnesses are studied.The third chapter analyzes the problems of information safety and the conflict between informationization and litigation principle and proposes the corresponding solution in combination with the actual situation in China.
