Abstract


Along with the deepening of economic globalization, intellectual property, as a high-level production factor, has become a direct impact on a country’s scientific and technological progress and an important factor in the development of productivity. Whether of intellectual property trade itself, or trade in goods, services, technology related, the development trends and growth momentum is closely associated with the protection of intellectual property. It becomes a new trend of modern trade to ensure national interests in international trade and trade rules of operation by an effective intellectual property protection. After China joins the WTO, the international financial crisis impact on China’s economy severely, independent intellectual property rights and complete protection will become key factors for China’s transformation from "Made in China" to "Created in China", and enhancing the competitive advantage of china’s international trade.The paper chooses the effect of the intellectual property right protection to competitive advantage of china’s trade as the research object. It tries to use standard analysis method to analyse the effect of the intellectual property protection to independent innovation, trade competitive environment, trade disputes and advantage areas of intellectual property rights, which can influence the competitive advantage, and use empirical method by introducing the trade competitiveness index and building econometrics mode to analyse the relationship betweet intellectual property rights protection and competitive advantage of china’s trade. The research has two aims, the first is clarifying the effect of the intellectual property right protection to competitive advantage of china’s trade; Second, to propose some useful advices to improve the competitive advantage of trade in china.Based on research framework, the paper is divided into five parts. The first part introduces the background, purpose and the theoretical research of intellectual property protection ; the second part analyses the status and existing problems of intellectual property protection in China as a whole, and points out the achievement and existing shortage of China’s intellectual property right protection; the third part uses standard analysis method to analyse the positive factors of the intellectual property protection which can influence the competitive advantage of china’s trade, then uses empirical method to analyse the relations and effect degree of intellectual property rights protection to competitive advantage of china’s trade. The result is strengthened protection of intellectual property rights will improve the competitive advantage of china’s trade; the fourth part focuses mainly on the status and existing problems of the competitive advantage of China’s trade under intellectual property right protection; the last part, in order to improve the competitive advantage of China’s trade, the paper gives some feasible advices to strengthen the protection of China’s intellectual property right base on government and corporation.
