Abstract


Frequent pollution accidents today, environmental problems intensified, the main reason is that the existing Environmental Protection Act, there are many problems, which, imperfect government environmental responsibility is the most fundamental issue. Protection of the environment is the bounden duty of the government, only to rely on the leadership of the government to speed up environmental rule of law, strengthen environmental supervision, in order to better address the serious environmental problems in China. Current environmental laws and regulations, the laws that constrain government behavior less and less government environmental liability provisions, only a few and representing the principles of government environmental responsibility to fulfill the environmental responsibility of oversight mechanisms, indolent punitive measures its environmental responsibilities, current environmental law does not make concrete provisions. This paper studies the order to achieve environmental objectives, the government environmental responsibility in the current environmental legislation should further improve what, in order to deal with the increasingly complex environmental issues. In this paper, the concept of government environmental responsibility, constitute, theory and reality background depth theoretical discussion, through the analysis of the government environmental responsibility flaws in the current environmental laws and proposed specific ideas to improve the government's environmental responsibility. In addition to the introduction and conclusion, divided into three parts: the first part of the \feasibility. This section will also improve the theoretical basis of the Government's environmental responsibility to make a detailed elaborate and clarify important effect for the protection of the environment and resources to improve the government's environmental responsibility, mainly from the four angles of the the environmental public commissioned theory, the theory of public goods, environmental rights theory. System and improve the environmental responsibility of government, focusing on starting with enhanced operability, including sound environmental responsibility legal system, strengthen the government environmental responsibility legislation; establish effective government accountability system, the focus is to establish a target responsibility system for environmental protection sound the main responsibility, while strengthening the legal responsibility of the local government; improve environmental supervision and management mechanism, mainly from to increase government environmental law enforcement, environmental regulatory capacity of the sector to strengthen the three aspects of the work of the local government regulatory leadership to be the focus of analysis.
