Abstract


In building construction activities, Contractor workstoppage is a common phenomenon. Which, when the contract for breach of contract, the Contractor to lay-off measures to promotethe Employer rectify the breach, to safeguard their legitimaterights and interests of resolving contractual disputes quickly and efficiently is of great significance. Existing laws and regulations of such contractors the right of the lack of adequate provision for suspension of work, so that the exercise of the rights of the obstacles encountered in practice. The author in dealing with similar legal dispute, the legal principle which is deeply clarifying and legal importance of the relationship, which this article intends to contract the contractor for breach of contract case, the right to study the work stoppage. Addition to the introduction and conclusion, this paper is divided into four chapters, respectively, from four aspects of the related topics discussed in this article.The first part describes the construction contract with the contractor for breach of contract related to the concept ofthe right suspension, and defines thecontractfor breach of contract with the contractor the right ofthe interface between suspension points. The second part of the Construction Contractor suspension of legal property rights. The third part through the suspension of the right ofthe Construction Contractor of the status of investigation, provided that the existing gaps and deficiencies。The fourth part of the suspension of construction contractors to build the right system, suspension from the contractor the right to exercise the principles, scope, components, procedures, subject, standard suspension damages and other aspects of the reasonable exercise of the right to lay-off has been studied and to put forward legislative proposals.
