Abstract


After the founding of the Chinese Soviet Republic ,to consolidate the new revolutionary regime,the Chinese Communist Party on the basis of learning from the experience of the Soviet Union ,actively mobilized and organized the people to carry out fruitful political power .In the process of building political power, the Soviet regime promulgated a lot of programmatic document and formulate a series of laws for the construction of the judicial system.During the particular war, some of the judiciary to set irregularities, inadequate judicial system, judicial work, lack of supervision, but under the conditions at the time, the judicial system still showed unique characteristics, many settings, and provides ingenious and progressive. The justice system of Soviet to establish and perfect the worker-peasant democratic regime consolidation and development played a crucial role in anti-japanese base area regime after, and the liberated areas and even after the founding of the judicial system construction hadimportant reference meanings.Conscientiously sumed up the pros and cons of justice system of Soviet, its essence, abandoned its dross, to deepen reform of the current judicial reform, further improve China’s judicial system, will play a positive role .Based on the judicial system of and Soviet ,the formation process of the judicial investigation of specific analysis, summarized the characteristics of the judicial system of Soviet, sum up the historical experience and lessons learned.The author describes it in seven parts:The first part:Analyzing the background of he judicial system of Soviet establishment and development, which was the revolution of the citation of the judiciary,inheriting from judicial system of the national government of NanJing, the Soviet union judicial experience .The second part:Discussed the judicial system regime, including the establishment of early judicial organs and the Soviet regime consolidation period of judicial organs, and expounded the establishment of the judicial organ, organization and function,to reveals the Soviet judicial system in the process of formation rules and characteristics.The third part:Introduced the judicial administrative organs of Soviet -the establishment of the Judicial Committee of the people, organizations and functions .Unified approach at all levels of the trial judge ,developing a unified standard, training of judicial officers and judicial cadres, so that the trial of the Soviet was on track.The fourth part:Introduced a judicial organs of Soviet - the establishment of the national political protection agency, organization, functions, obtained the characteristics of the national political protection agency to draw its advantages and disadvantages.The fifth part:Discusses the trial system of Soviet , the principles of trial, trial procedures to clarify the advantages and disadvantages, merits and demerits of Soviet judicial system.The sixth part:Summarized the characteristics of Soviet justice system.They were attentioning to the criminal relatived to civil crime,distinct class character,meeting the political separation of central and local meeting the political unity,One-trial review system,no truly independent judiciary.The seventh part:Through concluded the experience and lessons of the Soviet justice system, we get some historical revelation .Judicial democracy is an important condition for justice.Judicial independence is an important foundation of justice .Judicial supervision is the basic guarantee of justice.Equality before the law is the basic requirement of justice.
