Abstract


The rule of law and a harmonious society , the petition is an important way for most citizens closer to the people's livelihood Nefesh settlement mechanism , but also of citizens to defend their legitimate rights and interests , and it plays an important role in different historical periods . However , in a society in transition , with the rapid development of economic, political and cultural undertakings , all kinds of conflicts and disputes appeared in large numbers , the petition this right means of relief is also facing challenges , the petition system need further improvement , and the petition the issue of security of tenure is increasingly becoming the focus of the theoretical and practical circles . This paper is divided into four parts : the first part , starting from the concept of the right letter and classification , and analysis of the basic properties of the petition rights and related rights , through the mechanisms of the research the history of the development of the right of petition and abroad , on the Right to Complain carried out the investigation on the comparative law . The second part discusses the legal basis of the petition rights , the right relief theory , and the balance of power and the right theory provide an important legal basis for the protection of the Right to Complain . The third part of the analysis of the plight of our petition rights protection as well as the reasons caused this predicament , and thus provide the basis to solve the problem . The fourth part of the specific measures, including legal protection of the Right to Complain develop Petition Act , perfect settings to petition agencies , establish and improve the government petition responsibility system , etc. , through the of petition rights protection system , will be incorporated into the rule of law the extent of , and promote the improvement of China 's petition system .
