Abstract


Chinese medicine has thousands of years of history, not only of our people long fight with the disease and continue to accumulate a wealth of experience, but also elite important part of the national cultural heritage . In ancient ideological influence of materialism and dialectics , and under the guidance of Chinese medicine proven through long-term care , which gradually formed and developed into a unique theoretical system of medicine , health care for the cause of the Chinese people and the Chinese nation multiplication and prosperity , do a great contribution. The rapid development of science and technology today, with traditional medicine continues to spread and wide application of Chinese medicine is increasingly international awareness and attention. However, Chinese medicine in China has not been well protected, many Chinese medicine intangible assets lost in vain . Traditional Chinese medicine is outside the number of organizations and institutions to use and produce enormous economic benefits , resulting in the domestic pharmaceutical industry is facing severe challenges , resulting in a significant loss of intellectual property rights of Chinese medicine . Thus, the study and exploration of international protection of intellectual property issues in medicine , from a certain level to protect our traditional advantages of Chinese medicine , and thus help to improve the Chinese medical industry 's international competitiveness . This paper studies the theory of traditional Chinese medicine as a starting point , based on its own characteristics of Chinese medicine and present development status to the existing background of China's intellectual property system , from a legal point of view of Chinese medicine specialization , modernization and internationalization, through the use of comparative studies, empirical research , case studies, country studies and other methods , combined with Chinese medicine practice, the scope of protection of Chinese medicine to protect the ways and means to protect the existing system defects and other problems are analyzed and discussed. In this paper, the overall structure , in addition to the introduction and conclusion are divided into four chapters , the first chapter from the basic theory of traditional Chinese medicine to begin to introduce the scope of intellectual property protection in the pharmaceutical and significance ; second chapter describes the international protection of intellectual property rights of Chinese medicine conventions, organizations and some foreign practices ; third chapter analyzes the international protection of intellectual property rights of Chinese medicine avenues to explore its shortcomings , propose appropriate solutions ; fourth chapter mainly for Chinese medicine in China intellectual property protection measures put forward their own views and suggestions.
