Abstract


Climate change is one of the greatest challenges of humankind,and thus requires full and effective cooperation of international society,but such cooperation is too complicated to coordinate,the best way is to have international law rule the cooperation.Fairness is the most fundamental elements of international law,and also the main clue of this paper.The first part of this paper is mainly to clarify the nature and the main attributes of climate change , as well the necessity to have international law rule the cooperation.And then analyzes why fairness is the most important factor for international law to addressing climate change.The second part of this paper sorted out the configuration of allocation in Framework Convention on Climate Change,Kyoto Protocol,Bali Action Plan,Copenhagen Accord,Cancun Resolution.Found from the Bali Action Plan,the obligation of developing countries to mitigate climate change growing,and this trend lack of faimess.The third part of this paper discussed what is the configuration of allocation should be.On adaption action the developed countries should bear all expenditures of developing countries and on mitigation action the developed countries should achieve deep reduction of emissions.Also noted that when the amount of emissions converging in developing countries and developed countries,the fairness of allocation will become uncertain.The last part of this paper deemed that per capita emissions is the best way to ensure fair allocation of rights and obligations between countries.
