Abstract


Judicial Committee system is always special judiciary in the judicial Chinese special feature socialism system from producing up to now, at different times of the judicial field has always played an important role. In the pertaining to crime judicatory in present, along with the going deep into of principles like democracy rule of law,etc, the legal system for continuous improvement in the judicial practice of also being in the continuous reform. None of designs of any system is perfect, is more opposite than to progress day by day of principle with gradually complicated of judicatory practice to say all is need and accompany into, judge committee system have to also follow this regulation naturally. When a system appears a problem, there are various different voices in the head quarter announce a different opinion, also for judicial committee system to there is different theories, such as reservation, abrogation and modification...etc., the author is hereat drawing lessons from the foundation of other standpoints up announce own viewpoint for a while, don’t is a profound insight, just the embodiment of personal rough comprehension and not mature thought criticizes by expecting and corrects.The first chapter is a brief discussion of the emergence and development of the judicial committee. From the seeds of the system to its formation and development, outlining the history of its development. Also describes the various decisions during its formation and impact factors. By introducing the history to understand the meaning of the Judicial Committee, and then prove its existence at this stage necessary. Throughout its context, with different historical periods, to the Judicial Committee to form a historical analysis. With its background and impact factors, to understand what is the meaning of the system.The second chapter describes the nature of the judicial committee. First, a brief overview of the nature of judicial committee trial organization. And then expounding on the nature of judicial committee various different points of view, and analyze and understand one by one. Finally, the author’s own argument about the nature of judicial committee.The third chapter is about the Judicial Committee in the present problem. First, on the abolition of the Judicial Committee of the dispute. Then on the Judicial Committee of the reform. The third section is trial on judicial committee and other organizations.The fourth chapter is about the reform and development of judicial committee. Only from the perspective of judicial independence to the Judicial Committee discussed and recent at this stage there is a meaning and necessary also for the Reform of the limitations of this framework. For the nature of property is not changed, but the difference can be carried out in accordance with its specific terms of the division, after the long-term development for the foundation. In view of the specific measures are discussed in the section above, this is only the general direction of development issues to express their views.
