Abstract


In 2011, the legal system with Chinese characteristics has been basically formed , however , the law of life lies in the implementation . China 's judicial , law enforcement practice, law enforcement results were not satisfactory. \In this paper, the actual case from case participants and their social relations procedures and results for the case of the angle of the impact of a study , and further revealed : the parties lack of awareness of rights , the judicial system is seriously flawed , not high quality of judges , lawyers and judges to be the relationship leading to further adjust and improve the law can not properly implemented , justice can not be achieved just the important reasons. So as to arrive : To improve awareness of the rights of people involved in the case , to overcome the local jurisdiction , improve the quality of judges , the establishment of the rule of law in line with our social demands of judges and lawyers is to achieve the proper relationship between the correct implementation of the law to achieve justice and fair conditions . This paper describes mainly from two aspects : the first one : the case of participants and the relationship between law enforcement procedures and results for the case of impact . Mainly on law enforcement officers involved with the case between the affinities , decided to deal with cases of different procedures and results ; leading to the conclusion : the parties rights awareness is not high , law enforcement, judicial power is the localization of the law can not lead to the correct implementation of the the main reason. The second aspect : litigation participants and judges on the case of the relationship between processes and outcomes. Mainly on the parties , the relationship between lawyers and judges on the case of procedures and results have significant implications ; thus overall conclusion : the judge is not high quality , the relationship between lawyers and judges have not yet reached the requirements of socialist rule of law is the law can not lead to the correct implementation of the the main reason ; justice implementation requires lawyers to improve oversight functions . Case participants and their social relations procedures and results of the case the impact is a need to constantly deepening and improvement topics . As the author at the intellectual level , vision and other aspects of personal limitations , this article can not hide the many superficial and defects ; author on this topic in the future continue to in-depth study of the process will continue to improve and upgrade.
