Abstract


The antitrust settlement system is developed to a certain stage of the product Antitrust Law . With the enforcement of the antitrust laws gradually stern toward moderate , reconciliation system in favor of more and more countries in the world . However, the reconciliation system has incomparable advantages of traditional law enforcement methods , but in itself there are some limitations. China 's anti-monopoly law also provides for a unique settlement system - operators of commitment to the system , but this provision is too broad and abstract , and there are some problems and deficiencies . This paper attempts , the operators of China 's commitment to the system to make some suggestions and opinions on the basis of analysis of the reconciliation system . The article is divided into three parts . The first part is a general theory about the antitrust settlement system . Explains the emergence and development of the antitrust settlement system , analyze the reasons of its widely used to compare the differences and connections of the reconciliation system and related systems , and divided according to different standards for different types . The second part analyzes the rationality of the existence of the antitrust settlement system . This paper discussed the value and function of the reconciliation system , equity , freedom and order an equitable analysis of how the settlement system to achieve fairness and efficiency . And from the perspective of law and economics analysis , reconciliation system in line with the economics of the transaction cost theory . The third part of the vision to invest in our business commitment to the system , and pointed out that China 's anti-monopoly law on operators under the commitment system essentially belong to the scope of antitrust enforcement reconciliation .
