Abstract

Refugee problem is a significant influence in the international arena and complex issues , both from a humanitarian and protection of human rights perspective or from the perspective of maintaining international order , deal with the problem of refugees is very necessary . Protection of the rights of refugees also face problems, although China is no large-scale refugee immigration problem, but the seventies and eighties of the last century, received nearly 300,000 Indo-Chinese refugees, the protection of the rights situation is not optimistic, this paper is as a starting point to explore the legal protection of the rights of refugees and its shortcomings and improvement measures , hoped that through this study enables the Indo-Chinese refugees in our life be more perfect protection rights , as well as our country may face in the future refugee problem to provide a reference . Article is divided into four parts to China for the legal protection of the rights of refugees were discussed. In order to more clearly central to the discussion of this article , the first part of the article on refugee issues brief , mainly on defining the concept of refugees , that is referred to herein is strictly in accordance with the 1951 Refugee \Convention \In addition to this part also the refugee problem, the international community characteristics and the protection of refugees for a simple introduction to the discussion of the future provide some foreshadowing . The second part of our article on refugee issues and legislation on refugees was briefly introduced as the basis to continue to analyze the problem . China is currently the most important problem of refugees that live in the Indo-Chinese refugees , but China is still faced with greater potential refugees pressure. In China, for the refugee problem is only a legislative framework , and not very specific provisions to protect the rights of refugees . In the third part of the contents of the specific rights from refugee status and protection of departure , detailed analysis of the refugees right of entry , residence and exit right to work , education and other rights to protect the status quo. And the rights of the above mentioned analysis found that the current Chinese laws to protect the rights of refugees deficiencies . The fourth part of the article the author of the above analysis are summarized and thinking, suggested a solution for the protection of the rights of refugees, some of the ideas . Aiming at the existing problems should be taken to change the law and with the unified administrative act to protect the rights of refugees , and the right will have to face the problem , should begin to develop on the refugee determination procedures relevant legal documents , this document should include recognition of refugee status standards, refugee determination procedures and refugee determination of the competent authorities of several parts . Through the development of this document , our country to country in the short term for the person applying for refugee screening there will be a legal document references. The long run, to completely resolve the protection of the rights of refugees or have a special refugee legislation . The author of this that foreigners should be in a special law dedicates a chapter on refugee issues specific and detailed provisions , so as to better protect the rights of refugees .
