Abstract


Throw the thing and cause people to damage civil liability and arise at the historic moment unidentifiedly under the background of fact that the building distinguishes all in the summary skyscraper, the difficult point of this kind of liability for tort lies in being unable to find out real throwing people, thus make victims suffer losses, but it is difficult to find and compensate the person liable, the skyscraper is unidentified thrown the thing to cause people to damage ownly and become one and protect the victim, equilibrate the interests, the important infringement type of distributing the risk rationally. This literary grace analyzes research approaches such as law science and law philosophy,etc. with value, and throw the thing to cause relevant theories which people damage from the skyscraper, it bear responsibility theoretical foundations that subject establish, it is the applicable to belong to responsibility the theories of the principles analyze and should rules concretes applicable,etc. respect last analyses careful, carry on systematic research to the civil liability of throwing the thing and causing people to damage that such inflictor taking skyscraper as life background is unidentified, thus offer the suggestion of improving the relevant legislation of our country.This text divides four parts together:Part one Article 87 carry on understanding brief, in legislative background of analyzing to "liability for tort law ", study on the foundation on different opinions in the legislative course, analyse the basic meaning of this law article and meaning of the legal norm; Part two Will throw the thing and relevant responsibility systems and carry on the detailed comparative study unidentifiedly, and then this concept of deeper understanding; Part three Analyse and research and throw the thing unidentifiedly and damage asserting and it belong to responsibility principle of the responsible host, bear the angle from responsibility to throwing the thing to analyse and research unidentifiedly thoroughly; Part four Assist the relief route after putting forward some some besides "law of liability for tort"s.
