Abstract


Contemporary international IPR protection changes facing the breakthrough of the new system , such as traditional knowledge, genetic resources protection system . Protect a variety of intellectual creation and the creation of the \intellectual achievements and intellectual achievements on the \However, with the continued development of international trade , in the face of the conflict , the growing awareness of the importance of the protection of traditional resources , but because of the international community to define the concept of the traditional resources , essentially analysis is the lack of consensus about the \the object of protection , the protection of the specific content , specific procedures to reach a basic consensus understanding . Based on this situation , I tried to start from the \the essence of the final coordination of traditional resource rights and intellectual property rights more fully in the program . Through the analysis , I mainly come to two conclusions : First , the traditional resource rights do not belong to the intellectual property rights , but an independent in the current intellectual property system , a system of rights . Second , traditional resource rights belong to the kind of human rights , conflicts with the intellectual property rights , in essence, is a violation of human rights and intellectual property rights . With these two conclusions , I believe that the proposal of the concept of the traditional resource rights , break through the existing intellectual property model a new term , no longer confined to the intellectual property system , but from the height of human rights to the protection of traditional resources to provide a more comprehensive protection of ideas .
