Abstract


Rural land contracting and management succession issues , both in theory and in practice is a relatively complex issue . Currently, the land contract and management rights inheritance disputes occur frequently in the vast rural areas . Due to the principle of legislation too , and no judicial interpretation for reference , therefore the court in the sentence such cases is very difficult ' . Can inherit land contract and management rights and how to inherit , inherited way , courts are not legal for reference . How to solve this problem is a priority. The author is based on the status quo , the focus from the practical point of view , through the discussion of the Liwei Xiang , and Lige Mei land ownership disputes , focusing on the analysis of the legal issues involved in the current case . This article first briefly introduces the basic merits of the of Liwei Xiang , and Lige Mei land ownership dispute case , the outcome of the trial . Then leads to the focus of controversial cases in the trial process . On this basis , the focus from the practical point of view discusses issues related to inheritance of rural land contract and management rights . Rural land contract and management rights can be inherited , the heir of the land contract and management rights to determine the scope , the inherited land contract and management rights principles and methods, etc. described . Finally , I pointed out that China 's relevant laws and the gaps and proposed countermeasures to look forward to future litigation practices help summarize a case based on .
