Abstract


How to improve the circulation system of the collective construction land-use right, is directly related to farmers, agriculture, the stability and prosperity of the rural, and to the sustainable development of national economy and society. As to the circulation system of the collective construction land-use right, the theoretical discussion and practical exploration has continued for ages. Based on the present situation, reason, theoretical foundation and the practice exploration of the circulation system of the collective construction land-use right, this paper analyzes the circulation system of collective construction land-use right, and put forward some opinions about the system design and the reform of supporting system.Incorporating the practice and experience of the collective construction land circulation in some pilot areas, this paper analyzes the circulation system of the collective construction land-use right with consulting numerals related data. This paper is divided into four chapters: Chapter 1 is a brief introduction to the meaning and species of collective construction land, the concept, characteristics, circulation meaning and ways of the collective construction land-use right; Chapter 2 is about the status and reasons of the collective construction land -use right circulation. Through the analysis of the situation of the collective construction land-use right circulation, this paper points out the existing problems, and elaborates the internal and external reasons of the collective construction land-use right circulation; The Chapter 3 is about the theoretical basis and practical exploration of the collective construction land-use right circulation. In this chapter, the paper introduces some related theories and legal basis of the collective construction land-use right circulation, and make a feasibility analysis in theory; then analyzes the experimental circulation practice of Anhui Wuhu and Guangdong province, and states the significance of the practical exploration; Chapter 4 is about the circulation system design and the reform of supporting system, which is the emphasis of the paper. In this chapter, the paper firstly puts forward the principles which must be abided by when creating the circulation system of the collective construction land-use right, also make a design about the circulation system, including the circulated scope, the pre-condition, the main mode, the specific ways ,the circulated length ,procedures and the profit distribution. Then the paper proposes the tactics and measures to guide and regulate the circulation of the collective construction land-use right. The last part discusses the reform of supporting system, including: perfecting the collective land property right system, perfecting the legal system construction, improving the general land-use planning and control system, improving requisition compensation system.
