Abstract


In recent years, China's legislative body to actively explore various ways and means to improve the quality of legislation, after legislation is the result of the assessment system. Generalized legislative process theory that the legislation evaluation is an important part of the legislative process. Currently, our jurisprudence legislation evaluation system is still in its infancy, jurisprudence, practical exploration and theoretical studies of the blank makes legislative academia, the value of this system is not reached consensus. In this paper, a comprehensive survey of home and abroad, especially the local people's governments in China to carry out legislative assessment practices on the basis of the legislation evaluation system, focusing on building science in China. The introduction introduce the legislation evaluation work carried out throughout some cases, the importance of the assessment system and research legislation after elaborated, clear the thrust of the full text will be explored issues and ideas, as well as research methods. In addition to the introduction, the body is divided into four parts, the specific structured as follows: the first chapter, the concept of the legislation evaluation system. The opening chapter summarizes the academic world has a different understanding of the legislation evaluation concept defined in the legislation evaluation system. Legislation similar to the concept of the inspection of law enforcement, legal performance evaluation described the characteristics of the assessment system. At the end of this chapter reveals the theoretical basis for legislation evaluation system. The second chapter by examining legislation evaluation system in China's evolution. Introduce our country to carry out legislative assessment practice, review our legislation evaluation is still in its infancy, the status quo, summed up our current legislation evaluation system inadequacies, stressed the urgent need for legislation after assessment activities institutionalized norms and guidelines provide an empirical basis for the subsequent exposition legislation evaluation system. Chapter comprehensive innovation to build our scientific and rational legislation evaluation system, including the main assessment, evaluation objects, evaluation criteria, assessment procedures, to promote China's legislation evaluation system legalization. Chapter first to learn from foreign practices, to promote the legalization of the legislation evaluation system, and then establish a uniform evaluation criteria, multivariate assessment body reasonably determine assessing objects and improve the assessment process in four areas of post-legislative assessment system to build and improved. Chapter IV discusses the constitutional vision of establishing the feasibility and necessity of the legislation evaluation system.
