Abstract

Theory and practice of international investment operation, foreign investment in the whole operation in two stages to distinguish - Foreign Capital Inflow and foreign operational phase. Limit due to the the foreign operational phase of foreign employers are often less or substantially similar to domestic enterprises, foreign access to the legal system is particularly important. The telecommunications industry as an important economic areas, it is necessary to access to foreign legal systems of the telecommunications industry in-depth study on the problems and shortcomings summed. This article intends to introduce foreign access system for the telecommunications industry analysis, a list of foreign investment in China's telecommunications industry access system, this and other issues detailed analysis and recommendations according to the situation. This paper is divided into four chapters. First of all, the first chapter of this thesis describes the meaning of foreign access, access to the telecommunications industry foreign concept analysis of the state of implementation of the telecommunications industry access to foreign control, then introduced the framework of the telecommunications industry access to foreign legal system ( including the general legal framework as well as the specific telecommunications industry access to foreign legal framework). Then, the second chapter details the telecommunications industry, access to foreign general content (including regulatory body, allowing foreign investment into the telecommunications industry, the special requirements for foreign investors, foreign control restrictions and approval procedures), combined with revised in September 2008, \The third chapter first introduces the status quo of China's telecommunications industry to foreign access, and then analyze the problem of foreign access to China's telecommunications industry, including: there is a certain degree of transparency issues, the regulatory body independence doubtful, multiple regulatory body issues, the regulatory body to promote competition obligations not fully performed, as well as relevant laws and regulations (including: a comprehensive telecommunications law, the provisions of the so-called foreign \license system established by the existing laws and regulations system more complex, cumbersome). Chapter combination of the foregoing analysis, recommendations on improving foreign access system of China's telecommunications industry, including: translation publication system through the establishment of the legal text, legislative interpretation notes, and other ways to enhance the transparency of the legal system of China's telecommunications; establishment of an integrated telecommunications regulatory authority and regulate their regulatory actions; establish a more progressive, perfect, unified the telecommunications legal system (including the Telecommunications Act legislation, adjusting the outsourcing investors in the telecommunications industry as well as the existing permit system change).
