Abstract


Since China’s accession to WTO, the enterprises of China were often encountered on Trade Technical Barriers. It brought not only economic losses to China’s enterprises, but also greatly harmed the competitiveness image of China. And we can see many of these trade technical barriers were in the form of intellectual property disputes. Furthermore, in the internal business, as lacking a good understanding of the IP situation in today’s world, the enterprises often resulted in the waste development. And the essential reason was that there was not a blameless early warning mechanism of intellectual property in China.To solve the problems above, this article designed an early warning system for intellectual property, starting from a functional system and technological system design. In the functional system design, in order to achieve the goals at early warning and resolution of intellectual property disputes, this study designed the comparative analysis components, information update components, information query and push components, knowledge base system and expert system, also included their specific work processes. And in the technological system design, it designed the network topology and hierarchical structure.This paper focused on the core components-the comparative analysis components, especially the comparison rules, including patents, trademarks and copyrights. And it also established the foundation of the rules, intellectual property rights property system. In order to achieve an effective comparative analysis of intellectual property rights, the paper also discusses two main techniques for intellectual property analysis and comparison, which included the text and image contrast analysis techniques. In addition, the paper tried to find a new technical approach to resolve intellectual property disputes too.Finally, it made a simulation to analyze and compare an actual case by using the intellectual property early warning system designed, which can determine whether it can really play the role of early warning. The aim of the paper is to provide an intellectual property early warning system, which can help the China enterprises to reduce the risk of intellectual property dispute and resolve intellectual property disputes.
