Abstract


The beneficial right of educational administration of college student is an positive right in educational administration’s legal nexuses. Conflicts of interest of educational administration’s legal nexus often occur in recent years. How to consummate the law of educational administration, care and defer to student’s right,and maintenance their rights, have caused teaching staff even public’s concern. The research on consummating the beneficial right of educational administration of the college student has broken through the system of education, and become an collective topic in the domains such as pedagogics and law.On the basis of educational rule and jural theory, this article teases the contents of the beneficial right of educational administration of the college student, and analyses the actualities about it from analysing the legal nexus of the educational administration between the school and student through all kinds of methods such as canonical parse, applying theory to reality and comparative studies and so on. This article tables some proposals about how to consummate the system of the beneficial right of educational administration of the college student in our contry.The following article consists of 3 parts. Part one explains the beneficial right of educational administration consistting in the legal nexus of the educational administration, and expatiates on the contents of the substantial right and procedureul right of the beneficial right of educational administration, and analyses other correlative rights. Part two analynses the actuality about the beneficial right of educational administration of the college student in other contry. Then this part has a comparative studies between thier actuality and ours, analynses about the beneficial right of educational administration of the college student from legal system and practice of education. Part three tables some proposals about how to consummate the system of the beneficial right of educational administration of the college student in three aspects incluing the principle of educational administration, intramural bylaws, and extramural relief system.
